Will a drone deliver my next Amazon package?

By Adam Neely · Oct 1, 2026
Quick answer: The FAA's Part 108 draft rule could unlock citywide drone delivery, but 15 states plus Harris County, Texas are suing over the environmental review. Expect drones only after your city zones a launchpad.

The FAA’s proposed Part 108 rule would let certified operators fly drones beyond visual line of sight without today’s slow, expensive waiver process — the unlock Amazon, Walmart, Wing and Zipline have been waiting for. But on September 28, 15 states plus Harris County, Texas sued the FAA, arguing its July environmental review did not adequately analyze safety or environmental impacts. The FAA’s review modeled about 1,150 deliveries per day from a single hub at altitudes under 400 feet, with hubs kept away from noise-sensitive areas like parks, campgrounds and trailheads.

Deliveries already run under waivers in California, Texas, Arkansas, Florida and Utah — and a 2026 review concluded drones work best for small, urgent supplies when roads are too slow or unreliable. Practical takeaway for homeowners: noise and privacy complaints are real — one Texas resident described the sound as “like a beehive” — and some towns have frozen drone hubs locally, so expect delivery drones in your neighborhood only after your city zones the launchpad.
